Involvement in any criminal case is a daunting prospect and corporate offences relating to businesses are wide-ranging and complex, so specialist advice is essential. We are experienced in all types of corporate offences, including:

  • Business fraud
  • Environmental, health and safety and other regulatory prosecutions
  • Money laundering
  • Tax fraud

By working with our experienced team, you’ll receive practical, proactive advice and benefit from first class case preparation and representation, giving you peace of mind that you are in expert hands

Health and Safety Prosecutions

An accident in the workplace or a breach of health and safety regulations can lead to investigation and prosecution by the Health and Safety Executive, local authority or police.

Breaking health and safety law can have serious consequences. Under the Health and Safety Offences Act 2008, magistrates’ courts can impose fines of up to £20,000 for most health and safety offences and a greater number of health and safety offences make imprisonment a punishment option.

In fatal accident cases, businesses may face unlimited fines and other penalties under the Corporate Manslaughter and Homicide Act 2007 while individuals may be charged under existing health and safety offences and gross negligence manslaughter legislation.

Our criminal team offers expertise in health and safety issues and can also draw on the skills and knowledge of other members of our legal team, including our employment specialists, to provide co-ordinated advice on all aspects of the workplace accident.

Prosecutions brought by BIS (Business, Innovation and Skills Department)

The Department for Business Innovation and Skills (BIS) previously known as the Department for Business Enterprise and Regulatory Reform (BERR) and the Department of Trade and Industry (DTI) bring a substantial number of criminal prosecutions each year. They prosecute a variety of criminal offences such as:

  • Fraudulent trading;
  • Undischarged bankruptcy offences;
  • Breaches of disqualification orders;
  • Failure to keep proper accounting records.

By working with our experienced team, you’ll receive practical, proactive advice and benefit from first class case preparation and representation, giving you peace of mind that you are in expert hands

Regulatory Offences

Increasing levels of regulation means that more and more individuals and businesses are likely to need expert advice when facing regulatory proceedings. If you are involved in a business, you may need assistance and representation in the event of regulatory investigations or prosecutions by bodies including:

  • The Environment Agency
  • Fire authorities
  • The Health and Safety Executive
  • The Highways Agency
  • Local authority environmental health departments
  • Local authority licensing departments
  • Local authority trading standards departments

Our team offers experience in all these specialist fields and by becoming involved at the earliest stage of an investigation. We can guide and advise you throughout the case as we work to achieve the best outcome for you.

Road Traffic Offences

Most of us take our driving licences for granted but the consequences of losing your licence can have serious, costly and long-term consequences for your professional and personal life.  Our legal team includes experts in road traffic offences, who provide specialist advice and representation designed to assist you through investigation or prosecution for a road traffic offence and to minimise any penalties. Areas on which we can advise you include:

  • Careless driving
  • Dangerous driving
  • Drink driving
  • Driving document offences
  • Driving licence endorsements and disqualifications under "totting up" procedures
  • Early return of driving licence after disqualification
  • Failing to stop at or report an accident
  • Failure to provide a specimen
  • Insurance offences
  • Speeding and speed cameras
  • Use of mobile telephones while driving.

Our knowledge of road traffic law means that we are ideally placed to guide you through your case from start to finish. Even in cases where you intend to plead guilty, seeking expert legal advice can make a significant difference to your case, through skilled and knowledgeable representation that can help to avoid a driving ban or mitigate your penalty.

Proceeds of Crime Act

We provide a service covering the whole range of offences and procedures within the Act which are connected to criminal investigations. If you are being investigated or convicted of a crime the Crown or prosecuting agency can apply to the Crown or High Court for a Freezing order or Restraint Order in an effort to try and seize your assets. This can result in all your money, property and assets being at risk of being confiscated by the prosecution.  Should this arise in your case we can immediately apply to the court to resist the order being made and seek a stay or even discharge to allow you to manage your affairs and business activities. We have a team of Solicitors and Barristers who are now dealing exclusively in these types of cases.

We also have Forensic Accountants and other professionals who we tie in with our service to you to fight against these aggressive and crippling court orders. We will endeavour to preserve and retain your assets and help you prove they are lawfully acquired.
